PRIVACY POLICY (Atlast®)

This Privacy Policy describes how Atlast® (“Atlast,” “we,” “us,” or “our”) collects, uses, and shares personal information when you visit or make a purchase from tryatlast.com (the “Site”), contact us, or otherwise interact with us online.

1) Personal Information We Collect

A. Information you provide

When you place an order, create an account, sign up for marketing, or contact us, we may collect:

  • Contact information: name, email address, phone number, shipping/billing address

  • Order details: items purchased, preferences, order history, returns/exchanges

  • Account information: login credentials (if you create an account)

E. Subscription information (if/when you enroll)

If we offer subscriptions in the future, we may collect information needed to manage recurring orders. Payment information is typically handled by secure payment processors (see below).

Note: We currently do not use session replay tools (e.g., keystroke/mouse replay). If we add those tools later, we will update this Policy and/or provide additional notice where required.

If/when SMS is enabled, you can opt out anytime by replying STOP (or as instructed in the messages). Message and data rates may apply.

We retain personal information only as long as necessary for legitimate business purposes (e.g., order fulfillment, customer support, recordkeeping, fraud prevention) and to comply with legal obligations (including tax and accounting requirements).

We use reasonable administrative, technical, and physical safeguards designed to protect personal information. No method of transmission or storage is 100% secure.

9) Children’s Privacy

Sale/Share

We do not sell personal information for money. We may “share” personal information for cross-context behavioral advertising where enabled. You may opt out via a “Your Privacy Choices” link if provided and/or through a recognized opt-out preference signal like GPC where required.

Sensitive Personal Information

We do not use Sensitive Personal Information for purposes beyond what is permitted by CPRA without providing appropriate rights/choices.

Exercising California rights

To submit a request, contact us using the information in Section 13. We may need to verify your request.

12) Changes to This Policy

We may update this Policy from time to time. The “Effective Date” above reflects the latest version. Material changes may be posted on the Site.

TERMS OF SERVICE (Atlast®)

These Terms of Service (“Terms”) govern your use of tryatlast.com (the “Site”) and any purchases from Atlast® (“Atlast,” “we,” “us,” “our”). By accessing the Site or purchasing, you agree to these Terms.

1) Eligibility

You must be at least the age of majority in your jurisdiction to purchase from the Site.

2) Use of the Site

You agree not to misuse the Site, including attempting to disrupt security, scrape content, or use the Site for unlawful purposes.

3) Products, Orders, and Pricing

  • All prices are shown in the currency displayed at checkout and may change at any time.

  • We may limit quantities, refuse orders, or cancel orders at our discretion (including suspected fraud or resale activity).

  • If we cancel after you’ve been charged, we will refund the applicable amount.

4) Shipping and Delivery

Shipping timelines are estimates and not guarantees. Risk of loss typically passes to you upon delivery to the carrier or upon delivery to your address (depending on applicable law and carrier terms).

5) Returns and Refunds

Returns/refunds are handled according to our posted Return Policy (if provided on the Site). If no return policy is posted yet, email hi@tryatlast.com and we’ll work with you.

6) Subscriptions (if/when offered)

If you enroll in a subscription:

  • You authorize us to charge the payment method on file on a recurring basis per the schedule disclosed at checkout.

  • You can manage, skip, pause, or cancel according to the instructions provided in your account portal or subscription emails (if/when available).

  • Pricing, frequency, and products may be updated with notice as required by law.

7) SMS Terms (if/when offered)

If you opt in to SMS:

  • You consent to receive recurring texts (marketing and/or transactional) from us.

  • Message frequency may vary. Message and data rates may apply.

  • You can opt out by replying STOP (or as instructed).

  • Consent is not a condition of purchase.

8) Intellectual Property

All Site content (text, graphics, logos, images, design, and layout) is owned by or licensed to Atlast® and may not be used without permission.

9) User Content

If you submit reviews, comments, or other content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content in connection with our business (unless prohibited by law).

10) Health / Wellness Disclaimer

Our products are not intended to diagnose, treat, cure, or prevent any disease. Individual experiences vary. Use products as directed and consult a qualified professional if you have questions.

11) Disclaimer of Warranties

The Site and products are provided “as is” and “as available,” to the fullest extent permitted by law. We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.

12) Limitation of Liability

To the fullest extent permitted by law, Atlast® will not be liable for indirect, incidental, consequential, or punitive damages. Our total liability for any claim will not exceed the amount you paid for the product(s) giving rise to the claim.

13) Indemnification

You agree to indemnify and hold Atlast® harmless from claims arising out of your misuse of the Site, your violation of these Terms, or your violation of any law or third-party rights.

14) Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

15) Disputes

You agree to first contact us to attempt to resolve disputes informally at hi@tryatlast.com.

Optional (common in ecommerce): arbitration + class action waiver.
If you want that added, tell me and I’ll drop in a clean, standard clause.

16) Changes to Terms

We may update these Terms from time to time. Continued use of the Site after changes means you accept the updated Terms.
